You are at fault for knowingly hiring an undocumented worker, and you must face the consequences.
If you fail to report this abuse to the authorities, then you must be prepared to face more problems at a later time.

My advice to you is to talk to an Attorney ASAP, and take this matter to the law enforcement.

Thanks a lot to all members for being with us in this struggle. We have tasted our first big success this year. Credit goes to each and every IV member. We were all affected by the visa bulletin fiasco and this is our victory. This is a victory for all our members and we must rejoice.
IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.

USCIS UPDATES COUNT OF FY 2008 H-1B CAP FILINGS
WASHINGTON � U.S. Citizenship and Immigration Services (USCIS) announced an updated number of
filings today as the counting of H-1B petitions received on April 2 and 3 continues. On April 3, USCIS
announced that it had received enough petitions to meet the congressionally mandated cap for fiscal year
2008 (FY 2008) and that it would conduct a computer-generated random selection of cap-subject petitions
filed on Monday (April 2) and Tuesday (April 3) to determine which cases would be accepted for processing.
As of April 9, USCIS has determined that approximately 119,193 of the H-1B petitions received on April 2
and 3 are subject to the FY 2008 congressionally mandated cap.
USCIS received on April 2 and 3 a total of approximately 12,989 cases requesting an exemption from the FY
2008 H-1B cap because they were filed on behalf of aliens holding a master�s degree or higher from a U.S.

1) Was there an LUD update on ur I-140 (Last Update Date on the USCIS.gov website)
2) What Service center did you guys file in?
3) Do your recept numbers start from LIN or SRC?

2)Filed in Nebraska,on July 02 at 11am.Signed by C Uhrmacher,
3)Receipt numbers recd for self and spouse for I485.I765,I131.Receipt dated 08/08/2007.All numbers start with LIN.

My case has some similarities, except marrying an American and divorce, but I was out of status for a long time and I thought there was no hope at all. One of my former clients offered me a job and sponsored my h1 of course. I went home and have my new h1 stamped and came back. I was out of status probably for more than two years. Now, I just got my receipt for July 2 485 application. My PD is April 2006. I'm read people are talking here that when you re-enter on a new h1, your previous out of status "status" will be irrelevant.

Hello all,
Just had a quick query, I've been following a lot of activity on the whole matter of multiple visa filings, of which I was completely unaware of until recently, My question here is If an applicant has his visa filed from 2 companies and both these visa's are approved OR if just one is approved and the other loses out (say because of a lottery - which I heard is likely for advanced degree quota too this year) -
At the time of having the H1 stamped... Can a person pick either of the two companies?
I appreciate any feedback and a source of information would really close this case
No flames please, I, like many other MS students, have worked hard at a very different and expectedly challenging educational system in the US and after everything landed myself in a good company that wants to hire me FT and would hate that everything worked for would be flushed away in a lucky draw!
Seems very unfair that someone should have 3 approvals and 2 other people go back home because of this. There is a big question of ethics versues survival here so I don't want to go further into that territory.

Ok, i had the same problem.
Surname: blank
Given Name: First Last.
But in all US documents had it correctly distinguished. Recently when i renewed my passport i got it fixed at NY. You DO NOT NEED a news paper ad for this kind of change. I went to NY Indian consulate personally to ask this question as no one was lifting the phone. The person over there gave me a special form to fill it out and get it notarized. I did all of that and they printed the name correctly. Another guy had same problem, he did not even filled out that form, but they corrected his name as well. I was surprised how lenient these guys are.
Me and the other guy were joking on the way back in train because they did it for him without the special application, its like they don't care what name you have, " do you want Tom Cruise, i will write Tom Cruise - no problem at all, or even better, we will give you passports with empty name column, you fill it up with whatever you want :) "
Don't worry guys, this change is easy and this does not impact 485 as well, as long as you have always reported your correct name in your other USCIS documents. THEY KNOW that internationals have their names goofed up in their passports. Its not new for them.

But majority of the guys here missing the consequences of her intentional acts on society
1. Who were responsible to happen such inhumane act ? Was it Cop ?
2. The top most CRIME in this world is crossing another sovereignty country's territories ILLEGALLY and INTENTIONALLY ? BUT FORGIVE HER ?
3. Let her DRIVE with out driving license and KILL Children , Women and Everyone on the roadway ? FORGIVE HER ?
4. Let her shop lift for FOOD before her kids , Let her teach the same instead of sending them to SCHOOL, Let her make them CRIMINALS ? FORGIVE HER ?
5. Back in Home country, Let POOR from neighboring countirs enter into country on Humanity, let them attracted by anti social groups, Let those groups use them as PAWNS to kill Innocents ? FORGIVE THEM

Even one year after July 07 bulletin, the State Department is saying that USCIS is not estimating accurately. Where is the question of estimates, they should look at ACTUAL data.
And where is IV management? Yes, people should work with their state chapters.....but now is the time for the core IV group to wake up and take up the fight with the higher ups in the goverment. Show them how the State Department + USCIS is treating immigrants because of their lethargy and laziness.
I think state department has made a mistake by writing that USCIS can not estimate (in the latest bulletin) and we should take full advantage of it. Complain-Complain-Complain, make them look bad, and in this election year they may act on it...........
Please stop taking out the frustrations on IV. It is very easy to do. All you need to do is write a post. But doing some real action is the challenge.
We are all like you and in this together. We try to create action items and guide and try to lobby within our limited time, energy and means. Everything else is dependent on members. If members contribute funds we lobby hard. If members are not even willing to contribute $5, and we can only get less than 5K in more than 2 months, how can we accuse core? If members write letters to administration or USCIS, call lawmakers, meet lawmakers etc that directly helps everyone. Members need to involve their big employers and have them contact administration and local lawmakers. We all need to contact media and raise awareness. We all need to create publicity of this effort so that more people can join it and make it successful. We will help you all the way in this effort. Come and travel to DC with all your state chapter members and meet officials. Try taking part in conference calls, answer emails and calls from all kinds of members and non-members, media outreach and mundane official work of IV yourself during office hours and you will see how difficult it is to manage this for IV team.Take days off from your work spend your own money on travel and hotel and visit offices and talk to lawmakers in DC. We will help you with the meetings. IV core has been doing that and we get such brickbats through such posts.
Just accusing IV, writing posts about ideas or action, and asking IV to wake up will not solve anything. This is a community effort and each IV member is responsible for the failure or success. IV leaders already devote lot of time from their professional and personal life on this effort. Individual members need to step up if they want more and take it upon themselves to get active.
