Thanks for sharing this story with us...we truly appreciate it.

I joined a small company right after graduating from a university in the US with a masters degree. At the time of joining, I was told orally that my GC will be processed in a timely manner. Being naive and timid, I did not press the issue and months became years before the employer agreed to file my labor after work for the company for 5 years (1 year of OPT right after school + 4 years of MS). Although I work in high-tech and would have qualified for RIR, the company lawyer convinced me to apply using the traditional route promising the entire process would take two years. Once again, being naive I agreed. Now, I am on my 8th year with the same company with my labor stuck in BEC, and no relief in sight. I can look forward to years more in the same position and same company! Sadly, though I am highly respected senior member of the company (in terms of knowledge and time with the company), people who joined after me and were trained by me, have gone on to Managerial positions, while I can only sit and watch.

I do not blame anyone or anything for my predicament, except my naivety. At least, I am glad for sources of information such as immigrationvoice, immigrationportal and immigration-law that have helped me immensely with my education on all matters immigration. Now, I feel I know more than my lawyer and cannot be convinced to take foolish decisions. So, it gladdens my heart to see that we in immigrationvoice seem to be having some impact on the lawmakers as it feels like I finally have control over changing my status quo.

That really helps. But we need more stories from IV members. It need not be earth shattering like being a researcher in some cutting edge lab or an exec in a top 50 firm. We all have our own stories

If you read the first post, the senator (I think it was Kennedy) made a big deal about some immigrant he knew who had a very 'ordinary' life. All of us in IV are atleast one step ahead in the sense that we all are 'highly skilled'.

It could be about a Software Engineer who cannot get a promotion and has to reject more lucrative/satisfying offers from other firms to a person who is qualified as a High School teacher who cannot teach because she does not have an H1 visa

It could be about someone getting frustrated and applying to Canada as a backup otion or someone. Someone else might have a spouse who has been on H4 for 6 years and now cannot work inspite of avaiability of sponsor because one may use only 6 years of H visa.

Guys, unless we all chip in, lets forget about getting any resolution to this issue. IV is doing all it can and has been getting some success in getting amendments introduced. But unless we all step up to the plate, we can assure you it will be very difficult for us to protect these amendments in the senate. House conference will just chew us until we make some noise.

There are 3000 members on this forum, can't we even get a 100 decent stories to pass on to the media? Its difficult to convice media to write about us with only 5 people's stories......please chip in....as promised, no personal info about you will be revealed, unless you explicity mention that to us....

There are only a handful who are active. EB3's are screwed so bad that they have resigned to fate or comtemplating using AC 21 and reapplying in EB 2. i have tired pointing it out to many that EB 3 as a whole is in the same boat, few care and the July filers are happy in the land of EAD/AP.

Some people like me who really love what they do and dont prefer changing jobs have reached a point where they are begining to think if it is all even worth the wait. You will not find a sleeping giant, rather a depressed giant overrun by a bunch of koolaid drinkers.

    I couldn't have said better :))
Screwed up by lawyer's incompetence and bad timing :(

He protested against the Vietnam war. http://en.wikipedia.org/wiki/J._M._Coetzee
That is a valid reason for a Green Card rejection. I dont think this will hold water. Its obvious that dissent or negative feelings towards the war (in any time especially in the 60s was definitely against the administration policy.

    Dear IV:

Congratulations to all and thanks to the members who have sacrificed personal time and family time, putting others before themselves. May the gods shine forth and bless you and your families. I am proud to be a member of IV tonight.

u guys are negating the effect of the "gandhigiri" by sending the flowers and then sayin f$#k u for screwing it up, thats a stupid strategy and fails the essence of the "gandhigiri" cAmpaign

You are missing the point folks!

Please try to stick to this message (or something along those lines).

I understand your agency does all it can; Do the best job it can.
I also hope you empathize with the frustrations of a legal immigrant.
A small token of peaceful protest and hoping for the best.

I know you are all angry but please please please control yourself. We want to sound mellow and sympathetic!

No one expects USCIS to change their decision because of this! The flowers and the message are ONLY to make a point!

Everything will be explained in the letters we mail to the media but it can only work if we stick to that message!

we don't have to agree and support everything. IV does what benefits majority of the people (directly or indirectly)

No worries with the luck, If I was lucky, I would have had my GC by now.

BTW, many thanks for a civilized discussion.

It was always the same from my side.

I do not agree with what you have to say, but I'll defend to the death your right to say it.

I am sorry to say this Pappu, but honestly I do feel one thing. There are some things that IV can do without spending money(which I think are not being done). For example, it can lead everybody everybody to send letters to USCIS and congressmen and the press for justice highlighting abrupt actions of USCIS. I made so many pamphlets in the thread "Lets get Organized" which can be sent alongwith to make an impact. It is not about eb2 or eb3, it is about accountability and transparency from USCIS. It does not involve any money from anybody excepting a 41 cents stamp on the letter which I think most of people should be ready to spend. However, the push from IV seems to be missing.

With all due respect bsbawa10, although I am not a IV core member but I do believe that IV does a lot of stuff in the background that the visitors of this site are probably not aware of (until they join a State chapter). IV probably in consultation with its lobbying firm strategically focuses on the most important issues ailing the legal immigration community. IV comes out with campaigns when they know it will matter the most. It is probably not possible for IV to go back to USCIS/DOL with each and every complain its members come up with.

However, I do agree with your views on asking USCIS to be more transparent and accountable for its actions. And I don't believe IV needs us to show direction in such cases. You and me make up IV, and we can start campaigns on our own as well. I applaud your efforts to go after USCIS for what you are vying for. I am sure many like-minded souls including me will join hands with you. But all of us need luck to make these campaigns successful. I say so because there are lot of inactive folks in this forum who don't even want to spend $0.41.

...but we will keep trying! :)

Since processing time for Nebraska is 09/08, don't u think people in august get processed?

If Processing time is shown to be Sept'08, it means filings 'received' in Sept'08 or before have been reviewed. 'Received' date is what shows in your online status as '...you case was received on...", not what is printed on your receipt. If there was no issue, most likely are 'preadjudicated'.

I am waiting for someone from IV core to endorse the idea.

This was discussed in a conference call with core today - a bunch of flowers may not even reach the intended person. Such a campaign may look good in movies only.

The concept of IV is to communicate in the most effective manner. Do please come up with innovative ideas - and see how best we can utilize them.

Do not open new polls and threads for these activities.

First and foremost, a Big THANK YOU to all the IV core team who along side their full time jobs were working behind the scenes in getting this done and having to go through the hecklers and naysayers.

A big thank you to Congresswoman Zoe Lofgren in helping pass all the pain and outrage of legal immigrants to the people incharge and making them listen.

Also last but not the least, every active member of IV who participated in the flower campaign, in San Jose rally and in actively informing media on IV projects to showcase legal immigration issues. And for keeping saner heads in the insane times.

BUT WE ARE FAR FROM ACCOMPLISHING WHAT WE SET OUT TO DO.
    KEEP THE FIGHT ALIVE

This is not a legal advice to anybody, just explaining who I did!! Risk is yours!!.

On my passport "Surname" was empty. Complete name was under "Given Name". Assuming on passport:
    Given Name: Harjinder Singh"
    Surname: ......empty....

Just went to Embassy of India - Washington DC. Filled a "Miscellaneous form" and under purpose pick OTHERS and write Name Split". Then write on form what you want.
I requested " Split my name as Given Name = Harjinder; Surname = Singh".
Attach a photo on form, pay 20$ fee and collect a corrected passport next day.

As long as you are not changing the name this should be fine otherwise what will be in advertisement " My name is Harjinder Singh and I want to declare my new name is Harjinder Singh???" unless changing a name it seem simple 2 day task via Miscellaneous form.

Rest EAD / 485 I don't know because I am not at that stage yet.

    Regards
