If they keep the ON HOLD status for more than 45 days... That event is again a potential lawsuit material.... Because they are changing a Long standing practice which requires lawmaking ( ref: Rajiv Khanna's quote)
Regd AILA lawsuit i believe they are deliberately delaying so that USCIS change the Bulletin to C on its own ( from the fear of lawsuit). On the other hand USCIS is not doing that because they knows this weakness of AILA and trying to keep things stretching so that when OCT arrives this whole move will get weakened .... As soon as new bulletin with some availability comes out peoples will start losing motivation ...
I strongly believe that AILA and USCIS are cousins with the same last name. I smell something fishy when AILA files a lawsuit against its cousin.

Now with Atlas America off...What's the best alternative?, I'm running out of time here...
Friends, please suggest. I bought ICICI lombard 3 times previously, never had to use it, so no comments there. Now, I'm thinking of buying something better as I had heard horrible things about ICICI lombard.
Anybody who has had a parent with diabetes and taken insurance? If there were any problems, did the insurance pay the costs? If possible can you also mention what problems came up during the stay.
Thanks.

India has not moved an inch (may be has retarded in its growth) forward when it comes to quality of life or individual freedom or Govt.-public relationship. You can't do just with money. Money doesn't buy everything one need for a peaceful, happy life.
And, an individual or a group in India cannot fight against anything that is evil in India. The option for people is to go places. So, the politicians are responsible. I am not surpirsed by your question "how come the 'inncoent' politicians responisble?" because Indians' thoughts have changed so much that we accept and expect politicians to be evil, corrupt, inhuman etc. I mentioned people as smart in irony and I am sorry that you couldn't understand that!
No one was forced to leave India? What if you join an IT company and if the only option is to come here? Will you resign? Does everyone have the luxury of saying no to a job and pick up what they want? Which world are you? It's rat race back home. Do you know how many people have changed their and their families fortune by coming here?
I am only supporting somebody who said it is so frustrating that we have to wait so much for a GC. He didn't really mean that he was going to tear his GC, once he gets it. He was so much frustrated about it that he wont be feeling happy about it anymore. But, many have started shooting at him already.
Live in peace. I dont think this is a forum to see who is 'smart'.
Do not tear the GC, instead if you ever receive it and decide going back to India, frame it. One may never in his or her lifetime wait for an entity so much desperately as we all have for the GC.
WillWin, I do not agree that India is not moving forward. Infact people in India are raking money. We should not blame politicians or anyone for the state we are in. No one forced us to leave India. Defending our decision to leave India and come here by calling us "smart" is demeaning to our friends back home. Does it mean that they were not "smart" and hence stayed back? If at all, I would say they were the smartest and are reaping the benefits today.

they call it 'attrition'! how much is their level of loathing immigrants that they hope they become desperate and either die from hunger or leave the country
From Herndon, Va.s Labors (http://immigrationvoice.org/forum/showpost.php?p=150038&postcount=951) New York Times Editorial, August 18, 2007
Heres what Roy Beck, the executive director of NumbersUSA, the hard-core anti-immigration organization, said in an e-mail after the Bush administration announced a border-and-workplace crackdown: The illegal alien communities and the outlaw businesses that hire them are in a panic this weekend. It is most important that all of us contribute to that panic and ensure that it continues.
What is a reason to believe that they don't have similar opinions about us?

It is very easy to prove that USCIS did injustice to those with EB3 dates prior to 2004 or 2005 if they stick to the rule of FIFO.
If the first criteria is met, everyone with a PD older than the lastest EB3 ( I know some who got approved with EB3 PD Jan2007)approved so far should also be approved. Or USCIS should go and revoke the GC's to newer PD and allocate them to older PD in the EB category ( I don't like this option).
So let us dream and someday it will come true. If we scream soon our throat will go dry.
Peace...

Hi All
I have been following this thread for the last few days and wanted to share some info. Hoping it would be useful.
I entered the country in Jan 08 using the AP while I was still working for my GC sponsoring employer. Then in June 08 I joined another employer by transferring my H1B to the new employer. I did have the option of using EAD but I wasn't sure if the renewal will come before the expiry of current EAD. So decided to transfer H1 and my new employer graciously agreed to it.
We did a premium transfer so got the approval in 2 weeks. Money does wonders (Almost like the proverbial paper weight with files). I confirm that the I94# number on I797 approval notice is same as the I94# number I got when entering the country in Jan 08.
So this should be a good news for folks who are trying to do the same. I am in a different boat right now. I have to travel to India this November. I plan to return using AP. But now my employer is different from my GC sponsoring employer. Another issue is that I am going only for two weeks while my wife will be in India till Mid Jan. So we will enter US separately using AP. Please share your thoughts if you have been in this situation.

Here is another question. Its about leadership but uses immigration as an example.
"This is just one example of our political status quo: America's LEGAL immigration system is in dire need of a reform. Even though the members of Congress agree to that, they are not able to or not willing to bring about such a reform. Their hands are tied because of a certain powerful focus group who won't allow ANY immigration reform unless it encompasses a comprehensive reform of a well-known controversial issue. Innocent people always get hurt in a war. And in this conflict its the legal immigrants, who have not broken any laws, are the ones who are suffering the most. Senator Obama, as the President of the United States, what will you do, so that the voice of the people can be heard and their problems solved instead of selected powerful groups bullying the lawmakers?"
Please vote. We need have people talking about our problems. We need to bring awareness about the difference between legal and illegal immigration. The likes of Dobbs often confuse the two.
Send the letters and vote for these questions.
Thanks!

BTW, you are right....
I was incorrectly equating personal actions and beliefs with IV's actions and goals. I apologize for that.
First of all, my action just represents myself, not IV. Secondly, I don't really care whether EB-3 ROW would quit or join IV. To be frank with you, my PD is just 3 month away from the current date (EB2 China). From what I know now, immigration reform won't reduce my waiting time significantly. I have contributed to this organization, but now I decide to take some action of my own instead of contribute to this organization. It's quite funny that you threaten to quit this organization. This organization would benefit you much more than people like me since you are in EB3 ROW. But it is totally your call. I don't care whether you quit or not.

Sorry to hear about your case. Trust me, such liability suits are extremely common these days in America, and there is no cause for alarm as long as you take all the necessary steps.
If you had liability insurance for your auto at the time of the accident, the first thing you have to do is to call that insurance company and let them know about the lawsuit. THEY will hire and pay for a lawyer to defend you. If you want to be even more comfortable, you might also hire another defense attorney by yourself.
The catch is, your insurance lawyer will only defend you upto the amount of liability mentioned in your insurance. If there is any judgement over that amount, your personal assets are at stake. This happens only in very very rare scenarios. Most of the times, such lawsuits are settled out-of-court. The amount mentioned in the lawsuit ($3.25 M) is totally irrelevant- what they would eventually get (if any), will be far far away from this figure.
Assuming that there are no criminal charges, and this is a civil tort case, there will be no impact on your immigration proceedings at all.
Make sure you take all the paperwork very seriously and do not ignore any letter/notice/deadlines. Don't even think of running away- its not worth losing your career you have worked so hard for. Unless yours is an extremely unusual case, all that you stand to lose is several nights of sleep and thats all.

I am already in touch with my insurance claim representative. He told that the insurance's attorney will be responding to the suit and requested me the send the papers asap (which I am going to do today). and they will take care of attorney's expenses.
One more thing that he clearly told is, that they can pay up to $50K and beyond that I have to take care.
-- I don't have any assets here(like shares, house etc)
-- Though I have a house in my country(not sure that would be counted as asset here in this case)
-- Even my bank balance is minimal
I already went thru lots of pain since the accident, and when I thought its all over, it is coming back..Hope I will be able to pass this test, as it is not as complicated as long waiting of GC :)

If you heard what the restrictionist lawmakers have said about what to do with illegals, this retrogression makes sense. The restrictionists want to make life miserable for illegals by making it difficult for them to get jobs, this way the illegals would go back on there own.
They are trying to do the same thing with us legals (without saying it aloud). If you are from India it will take you at least 6 to 8 years (if you are lucky) to get a green card. Frankly in the fast changing technologically advanced world how many people can hold on to the same job for 8 years straight, they cannot. People lose jobs because they are laid of, the company has run into bad times, the technology has changed and the company wants to move you to a different role or position etc, this way a lot of people have to switch jobs which invalidates thete green card process. They are making your life miserable so that you are broken down psychologically and finally will go away either on your own or because of some arcane rule, example the labor should be applied more than one year before h1 expiration etc, a living example is that Indian guy who posted recently that he is leaving US to work for Microsoft in Canada. This way they get the best of both worlds, you have young people in the prime of there life without any diseases who do not burden there medicare system, working hard and paying social security taxes and medicare taxes (which they will not get back) and in the end they are kicked out or go away on there own.
You got it right or what!!! That sounds like the modern definition of slavery and seems to be what is happening in US despite all the claims of abolishment of slavery. They just have refined it to a point where it is subtle and not so blatant.

For diversity they have GC lottery. Having per country limits in EB categories doesnot make sense
from the July bulletin
Region All DV Chargeability Areas Except Those Listed Separately
AFRICA 35,500
ASIA 7,750
EUROPE 23,000
NORTH AMERICA (BAHAMAS) 12
OCEANIA 1,800
SOUTH AMERICA, and the CARIBBEAN 2,500
Unless they reject/disqualify 30k Africans and close to 20k Europeans I don't see the diversity here. Notice Asia, the most populous continent has a measly 7k. But thats a different argument for another thread.
I think increasing the total amount of visas per year is what we need.

$$$$$$$$$$$$$$$GOOD MORNING GC$$$$$$$$$$$$$$$$
Deadline = April 30th, 2011
Goal = 5000 votes on survey (see I-485 filing w/o current PD thread) and momentum to continue with this campaign. The survey is a platform to gather and push for launching action items. Based on response by 04/30/2011 - IV will decide whether to even proceed with initiative or not.
Actions - 1) Vote on survey.
2)Email ivcoordinator@gmail.com with PD, ph#,email & subject "I485 filing impacted,
3)Print/Circulate Fliers and spread FB, wiki link (see "support thread")
Dear IV Members,
If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.
For background click here -> Announcement about April 2011 Advocacy Days (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1901186-action-item-advocacy-days-in-washington-dc-in-april-2011-a.html#post2301599)
