    I did paid consultation to find answer to this question with murthy office. As per them, one can do transfer and extension of H1B even after using AP as long as the current I-797 is still valid.

    Thank you so much for sharing your information with the rest of us. It is people like you who makes this IV Forums so valuable.

    What 'casinoroyale' mentioned does sound logical to me. H1 can either be VALID or INVALID. (there is no third state). if its valid it can be transferred or extended.

    If someone says its valid but can not be transferred, means we are talking about a third kind of H1B here which is neither VALID nor INVALID. An H1B only valid with current employer and which can not be transferred or even extended. Thankfully, this kind of third state does not exists.

    However I am no legal expert on this and hence asking others to share their experience on this.

    Stay focused our (IV) Main Agenda, please dont get distracted with all these ideas.

    Krishna we are focussed on the main goal, Unfortunately we have yet to see any headway and may not see any this year either coz of the million other problems. Hence my suggestion of alternate strategies. Like I said, just a suggestion.

    I feel the pain buddy...I feel the pain. There is no rhyme or reason and this reasoning is BS ...since we all know people with later PDs and later RDs/NDs have been approved - the processing order is JUST a BIG MESS.

    When the senator inquiry was initiated? sometime in August?

    If they keep the ON HOLD status for more than 45 days... That event is again a potential lawsuit material.... Because they are changing a Long standing practice which requires lawmaking ( ref: Rajiv Khanna's quote)

    Regd AILA lawsuit i believe they are deliberately delaying so that USCIS change the Bulletin to C on its own ( from the fear of lawsuit). On the other hand USCIS is not doing that because they knows this weakness of AILA and trying to keep things stretching so that when OCT arrives this whole move will get weakened .... As soon as new bulletin with some availability comes out peoples will start losing motivation ...

    I strongly believe that AILA and USCIS are cousins with the same last name. I smell something fishy when AILA files a lawsuit against its cousin.

    You are right.. I got a call this Wednesday from the Presidents office of initiating an inquiry on my case and again a repeated call from them on Friday that FBI Name Check has been cleared. I forgot to mention this detail in my excitement.

    Can i know why you were called for personal interview. Is your I-485 Based on future Employment or did u have an Arrest record. If You have a record it might take a while to get your back ground check.

    In all areas, it is still honors based system - it is expected companies follow rules and laws. In each area, income-tax, police - law & order, business taxes, the way is less governance and more self regulation.

    Most companies follow it in letter and sprit; some don't. It is natural and it is discounted. You are working for success not perfection in government. And this is a free country. If you can (one day), make a better small and medium consulting company. That's what it makes the country great.

    Esp the Mom Pop Desi consultancy shops whose main objective is to prey on H1Bs...They should be banned.
    I agree that its the lopoholes or worse - Loose enforncement that encourages these consultancy firms to keep exploiting the system.

    It seems like any change in the immigration system is only going to land us in a worst position than we are in....

    And looking at what is happening, I think it is naive to think we can influence the system to make it better for us.

    Any noise we make seems to be making our opponents solidify and press us even harder.

    I know this is not an upbeat comment that every IV member seem to expect, but this has been a depressing week, in an already depressing decade. :(

    I mostly get reds for being honest and stating the facts but that doesnt matter. I have to agree with Nathan, dont get emotional, lets see how to get out of this mess. As you stated, your employer didnt invite you, the only thing he should have done that he didnt do was recalled your petition when it became effective. He will get away with a warning and a small fine unless he has done the same as a pattern.

    You can get him in real trouble, (of course but only by doing damage to yourself) by proving you paid the money for the H-1 and I sure here too, you would have given him a check and he would have given a company check to USCIS and you are going to make life more difficult for you than for him as proving you paid the money for the petitionis going to be very difficult.

    This is the time to sit back and think what is your real goal. I guess, it was to come here and work hard and succeed not make life miserable for everyone involved. Trust me Honey attracts more flies than vinegar. Speak to your employers softly and try to find a solution. If you need help finding a job, I am sure there are plenty of avenues, especially with the market improving.

    Now dont jump into conclusions, that I am another consultant or work for a consultant. I am neither.

    This suggestion is very good,There should be some fee to get access( to generate money).

    how about breaking this into multiple levels.

    (1) account maintenance fee: charge $1/month for maintaining the account, members who paid this fee will have read access to all threads except IV core updates. IV can generate $25K a month with this option, this can cover day to day expenses.

    (2) usage fee: charge $??/month for using the IV forums, members who paid this free can post and respond and read IV updates.

    If we do not get this problem resovled who will ? All the members in this forum please start taking active part in determining your future your families future and your kids futures.. please do not be short sighted or procrastinate. Take Action NOW, we can do this, please encourage one more person to join in and contribute, talk to other people who are not aware of our plight and educate them, contact your local lawmakers, be active on the forums, support the core members and each others, come on now guys.. may be all of us cant do every thing but try some things at some of the times and some other things some other times :) -- does that make sense .. I wish I was very rich I would have made a HUGE donation to IV to fight for their cause... I really respect the core members for their tenacity, dedication and inner strength to carry on this effort.. admist so much uncertainity and so many obstacles .. and the best part is .. most of the people who will benifit from it dont want to do much about it ..... ok .. I am exhausted now.... Logic Life .. how do you do it .. keep churning out .. one passionate and well thought out post after another ..     I wanted to add a few points again - after reading the previous posts from Alien2006 and Chanduv23.

    To alien2006' posts I want to add the following:

    Funny how many of us have noticed the flow of suggestive ideas that we are given right from the time we start the H1 process - back in our home country:

    1. Prospective H1 employer suggests the following (nothing in writing of course):

    "Great. You are very smart and deserving. We have choosen you to be one of the lucky few whom we will take to America this year after filing your H1-B visa. Once you land there on the H1-B visa, everything will be great. You will have a job in a few days with one of our clients (Buzzer - this is one heck of a lie - there are no confirmed jobs - one has to go through the whole process of interviews again to find a project where you will be accepted on a contract position. Rarely I have seen H1 companies who have projects of their own for their employees...but no one tells us that!!!). After you have worked with us for about 6 or 7 months we will file your green card and you will have your green card within 3 - 4 years. You will be all set with the wonderful American Dream in less than 6 years which is the validity of your H1 visa!!!. (Buzzer - One more great turd of BS - Yes they will apply our green card...BUT they may or may not pay for it...they will apply but there are 195,000 H1s and only 7000 Green cards per year for India - guess what MOST OF us will only dream of a green card and may never get one).

    Folks here shout at us about why we "expect" to get a green card when we "know" that we are here on a temporary H1 visa - WRONG - we know that H1 is temp - but we also are made to think that H1 is the first natural step towards a green card. Once we get here its a big wake-up call after about couple of years on how false that premise is.

    Also - if we are "temps" no one - employers, for that matter - any organisation that we come accros in our "immigrant lives" here in the US try to highlight that YOU Are TEMPS...WE JUST GOT YOU HERE TO BE A TEMP WORKED, EXPLOIT YOU IN WHATEVER WAY WE CAN, MAKE A QUICK BUCK ON YOU...and then put you on the sinking broken boat called "GC process" and forget about you!!!. No wonder we think we think that we deserve to a fair and simple GC process - but it should be made simple and fair - coz thats the sublimal message we have been dumped with for the past 6 or 7 years...its now time for them to come through on their promises.

    To Chanduv23 post - Yes I agree things are much better now...in the last 10 or 15 years....and probably thats the reason more people want to come here and work here...I know I love my job, the people here and the whole way of life here.

    I don't think this is true. But you put a seed of doubt in my mind, I will confirm with my attorney :)

    ItIsNotFunny, please DO SHARE once you are able to get some insight from your attorney. Meanwhile, I printed out AC21 IV campaign letters and went to each of my co-worker at my work-site and convinced them to send it. Hopefully atleast some of them will send it. Thanks for your effort on behalf of our "descriminated based on country of birth community" :)

    My understanding of SKILL for US MS is that it will not be counted against the cap. I don't see it saying that PD does not matter for US MS. What am I missing? Thanks.
    if you are not counted against cap, that is equivalent to visa available = PD current.

    Did it occur to anyone that we are only talking about compensating Aman the $64k he spent already. Imagine if he had made use of that $64k as an investment(let us say a safe investment with minimum returns) of that amount it should have exceeded that $64k value by now.

    The least we can do at this moment is to immediately refund Aman and other core team members the amount they have spent towards the administrative costs of IV. Pappu / Logic Life / Other core team members, please let us know what kind of legal/administrative action is required to get this done.

    We will immediately start a funding drive towards filling in this shortage from the total IV funds. IMHO on the longer run the smaller funds ($10, $20 etc) should not be neglected.

    Let us figure out the required amount and have a new thread started about this. This settlement should be treated with high priority before any other funding drive. Pledging my $200 towards this.

    Yes this is not a typo. This is true. Aman has made more financial sacrifices and time sacrifices than anyone else. Not a single penny has been reimbursed to him for his trips to DC, food and stay in DC or car rental in DC. He even risked his job and went to DC on unpaid leave at critical times because lobbying was important for getting our work done. We in the core team know this and when we see the kind of contributions we get from members, we feel disappointed that our efforts are not valued. When we started the $20 contributions people felt $20 was too high and wanted $10 per month or less. The kind of work and effort that is needed to push a single provision is phenomenal and needs lot of capital. The more the better. Sometimes reading posts that say IV core is selfish also disappoints us. People do not know the effort that goes in getting anything done. This website is simply a tool for us to communicate to everyone. The big effort is the lobbying work. We hope the Buisnessweek article helps people realize our hard work and people value it by contributing to it and helping us in all action items.[/QUOTE]
