We always thought that there is 360k application in BEC and since those LC have PD from 2000 to 2005 there are no chances of fast movement of PD in year 2007 especially for EB3 and EB2(Indian , China).
After reading this news it seems employer withdrew many cases, which they filled for employee who no longer work for company, so certified case is going to be only 100k, much lesser then 360 k. How many more years it will take to clear these 100k LC? I don't think it should take more then 2 years...
But you know logic doesn�t work with US immigration system and we also don�t know how many people are applying through EB1 and EB2-ROW, which are current, we also don't know how many people are already sitting in 485 stage�

I appreciate your enthusiasm. IV has directed all its members in the past to do what and when? They have also established a webfax mechanism and also asked IV members to contact the senators / congressmen. They have gone into the level of seperating statewise members and asking only certain state members to contact.
Once again I appreciate your thoughts. But the members should follow one direction and it should come from core IV. Do not do certain things without the consent from IV as it may back fire.

Man/Woman, I see so much energy here or could be just shouting. It would be in the best interest to use the energy to contact respective congressman/woman/senator of their area, ask them / request them to bring/pass legislation like SKIL and PACE. Tell them why this bill is needed. Tell them your problem. If everyone of us call congressman and woman and follow up with them on the progress that would be great. Am I doing it? Yep..Not joking IV members are involved.
IV guys can you develop questionnaire which we should ask the operator. What I did is I asked to operator to connect me someone who can help me in bringing immigration legislation. That is how I approached the operator. IV associates what I am getting at is how should people reach right person? As IV people have interacted with many senator office they have better idea what are different staffer there and how they are addressed, and how to reach them.
Let me know what are people thought? I think instead of wasting time, lets get to work. Help yourself by calling senator/congressman/woman. And this is oppurtune time.

How many IT jobs are there in Canada (assuming most of the members in IV are into IT)? Canada Alberta program increased processing times to 8 months now and it excludes federal processing times. Federal application method takes more than one and half years.
So its good that you have chosen an alternative and worked out well, but your alternative many not be an alternative or not even option to all!!!

I have an appointment with Murthy's attorney next week. SInce we have limit on PM I would suggest making a yahoogroup thread and include those in the same boat. My PD is Sep 05 EB2 India . it's pretty bad for me :-) Getting married next March (just need to find the gal - kidding ;-) )
Lets talk with our respective attorneys and separate attorney's personal benefit from this.
Ofcourse, all the Attorneys will tell you NOT TO DO CP SINCE THEY CANT CHARGE THIS Matthew Oh GUY and others want you to do 485 so they can milk more money out of you.

To raaj2007, just getting an EAD does not nullify your H1, but if you use EAD you loose H1. Go and check with your attorney. If you use EAD you cannot enter US using H1 or H4, you have to use Advance parole.

Answer - You can change employer after 180 days of pending 485 using AC 21 and you would be in EAD and use AP to enter US
(ii) After filing 485, do I HAVE to get my wife into US before the dates retrogress again?? Whoa never heard that...are you sure?
Answer -Yes, if you dont, you would not be able to file for her if the dates retrogresses again, also to file 485 for your wife , she should be in US at the time of filing 485.
(iii) Is there no step after 485 filing that I can keep postponing to not let 485 approve (like delaying 485 fingerprinting multiple times) so that I can let 485 approve only after I am married and can bring my wife in?
Answer - No, you cannot postpone it on your own will. But if your marriage date is before 485 approval (even one day) and tour wife could not make it to US, she can come to US using follow to join process. That process is also available if PD are current. In that scenario you ask USCIS to send US consulate in India to send a notice that the principal applicant's 485 has been approved and since the marriage was before 485 approval, she should be called for Interview at the US consulate in India and given the immigrant VISA, The Follow to join process is like Consular Processing.

Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.
As one of the 'not so many from south america that qualify for the EB visa', this comment just further draws me away from this forum.
Do you really think the 10k or so wasted visas will honestly make a dent in the demand? I highly doubt that the wasted visas are caused by ROW not applying or 'qualifying' because last time I checked there was still retrogression.

2 i-140's approved with same company, both are EB2, one is RIR one is PERM.
PERM one had Jan 2006 PD where my RIR had Nov 2004.
I-485 was applied using Nov 2004. USCIS may be looking at other one and thinking PD is not current. What a mess.

Another thing is that, after opening a service request, you can send a followup email to ncsc email address and get your query about priority date answered . I did that too and even got response from them . (Both A# consolidation and difference in PD)

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. Not that I know of. There are two 140 but both have AOS option - Is it normal that 140 application goes back to USCIS office ? AFAIK, there is nothing wrong with my 140 application . It is st. B.Tech+ MS+2 yrs type of case with permanent job (no consulting)

I dont see this going anywhere. Looks like we will be stuck on HR6020
