I have worked for some of the big Indian IT companies including HCL Technologies and Satyam and can tell you all that these companies are the most screwed up companies in terms of bringing in H1 and L1s from India and paying them peanuts for salaries. For example Satyam and TCS here in St Louis have a large outsourcing deal with Citigroup. There are about 50-60 Satyam Engineers here on H1 and L1 visas being paid around $45,000 per month+Benefits which is just about the Labor prevailing wage in this area.
Talk about rotten Desi companies and even the bigger players are not far behind in trying to suppress wages for Engineers and bending rules in lots of instances to bring in a flood of L1s/H1s from India to work on onsite projects.

As per government figures, federal government awarded 124,096 H-1B visas in the fiscal year ending October 2005, the most recent annual totals available. That includes renewed visas, which don't count against the annual cap. These dramatic exaggerations distort the reality and provide a falsified alarmist view of the situation; which works against the interests of Immigrants ,businesses and American economy.
In the interests of fairness, you should also air the counter-views while providing coverage to such strong one-sided views. This would provide a balanced coverage to your viewers.
In the absence of such unbiased coverage, Mr. Dobbs verbal attacks may provoke physical attacks against foreigners as well as any foreign-looking persons by misguided elements provoked by your show. If such incidents do happen, please understand that your network will be indirectly responsible and liable to the foreigners affected.

it is good indeed. but i just happened to visit aila.org and it says this news "no more labor subs" is just a rumor of the day.
can u provide a link. This rule is bad for AILA because of the loss of revenue and hence they were against it. But since this is in the "Final Rule Making" process there's not much they can do. BTW u don't need to have the I140 approved for the LC sub to go thru. U just need the labor substitution approved stamp before the rule gets published.

1. As for as I can see the 45-day rule comes in to force only after the rule is published in federal register. So all LCs approved after this publication will have 45days of life and has to be used by the original applicant. It's still a grey area as to how LCs approved before the rule publication will be affected. From immigration-law.com, my understanding is that all the LCs approved before this publication will have 45 days from the date of publication and if the I140 is not filed by then they'll expire. So all LCs approved so far will have 45days from the date of publication. Now to Labor sub.
2. Substitution of labor can be done by 2 methods
a. by amending the existing labor certification before approval
b. by substituting after approval.
3. When u do either 2.a or 2.b DoL stamps a substitution approved stamp on the LC.
4. If you are doing a labor sub and u fail to get this stamp before the rules goes in to effect then ur lab sub will be automatically rejected.
5. If your labor sub is approved before the rule is published in the federal registrar then u go ahead and file I140.

This is definitely scary. I think, we need to kick start our campaign again in full throttle. Last time, we thought, things were changing and we kind of stopped our campaign. There was a Ombudsman link where they suggested to contact them if 485 is wrongfully denied. Did someone contact them?

I would say it is a matter of pure judgement. It helps to stay neutral and make your best bet. For example, if you found a great job and the employer is willing to sponsor your H1B - why not go for it? H1B will be safe(r) anyday - it gives you and opportunity to plan for the unexpected. However, it would be imprudent to ignore a great opportunity by sticking to H1b. So, the thing is - don't lean on either side, just do the best that keeps you happy and safe.
One question though - If I apply for EAD & AP - do I have to keep renewing it inspite of using my H1b status? That would be a great loss money, right?

Many sites. What kind of alerts are you looking for? Vols? Greeks? You can also customize most of the alerts depending on spreads you might be trading. This is possible even in simple option accounts with Level 4 approval.

IT IS AS SIMPLE AS THIS ----
IV has to convince the government that this mess was created because close to 100000 visas were WASTED/UnUsed while BEC was busy(or not busy) sorting through the cases. If it is the mistake of a govt department, then the govt should fix it by recapturing these visas. They will act only when you make them look bad or file a suit against them. Why hasn't IV been able to push a simple argument like this????

It took almost 4 1/2 years to get the labor certification and now its almost 17 months since my I-485 is pending approval. Took the path of writing to the FL, State Senator, Local Congressman and was fortunate to receive their response suggesting that its stuck in the namecheck stage and will have to wait for it to be completed. It has become a nightmare.... The only update in my case used to be whenever I initiate a service request. Now what is that which I can do to come out of this riddle....
Any suggestion in this regard is highly appreciated !!!!

Did you even read my post and the pdf link. BTW, pdf link refers to Aug 21st, 2009 much before this memo came out. Even if memo is withdrawn, how that is going to change the points agreed by the court?

This memo does not make any difference that way. Like I said before, this memo just make the interpretation public knowledge.
Why these H-1B cases have been denied in last years and why these denials were not reversed by appeal court? These answers should enlighten you.
Just harping "illegal memo" does not change anything.

2. USCIS has been making these erroneous judgments in the past in reference to H1B applications. If AILA overturns this USCIS memo( which I think is most likely), all these USCIS arguments will be trashed.
Regarding the date of PDF (Aug 2009), USCIS has already been practicing whatever is listed in the Jan 2009 memo for past 1.5 years. The above said decision (PDF) was made during that duration. AILA is contending the very arguments made in Aug 2009 pdf.
Also on another note, one of the leading lawyer's client reported that he got his H1B approved for a multi-layered consulting situation without even a client letter. So it depends on the lawyer who is presenting the case.
Anyways let us wait and see.

Nope, if you think that the wait time is what makes a GC worth, then would you have liked to wait for another 10 years to make it more worthy?, on the other hand if you had got the GC the very next day you applied for it, would it have been worthless?.
The point I am trying to make is that no one can justify the wait time. it is torture.

What I am trying to say is that whether GC takes 1 years or 5years, it is worth the wait IMHO. If I have to do all over again knowing it could take 5-6 years, I will do it. But that's just my personal opinion.
