I am planning to get my visa stamped at the chennai consultate in January 2008. I will be visiting for 3 weeks and was wondering whether such a situation will persists during the month of January...

Yes - although we never know for sure, chances are high that the situation will stay this way until mid-2008 when they expect to build a central, electronic verification system.

That's interesting...from my visits to various threads and from wait times of my friends (3 to precise) who recently got naturalized, the average time after receipt of N-400 to taking oath is around only 4 to 5 months.
Good to know, thanks. Maybe we were reading different threads :) One thing though, because of the heavy rush of citizenship filing in 2007, combined with the election-year pressure of 2008, petitions were fast-tracked in recent years. There are so many confounding factors, anything is possible.

Fraud is not correct word, it is because of lack of policies or loop holes in the current Immigration System. This can be found in any system, any country, any people. So, there is no need to talk on that. It is better to put our EB related retrogression problems to Congress and no use in discussing these. Otherwise If you start discussing on fraud, every work done by everybody is going to have some kind of fraud. It is to survive and so people do whatever it is, with in the limits of law.
All people who are being labelled as socalled "Americans" came here like immigrats and theft the land from Native indians. So, everybody is doing wrong. That's part of time. This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. Anybody who has had a parent with diabetes and taken insurance? If there were any problems, did the insurance pay the costs? If possible can you also mention what problems came up during the stay.

There can be several things that we want to discuss and share. But isn't this platform supposed to be for immigration? If we start discussing about Best phone cards, airtickets to india, jokes, unrelated politics etc., we will soon loose the purpose of this website and forum.
If many senators, attorneys, other aides visit this website and can find all this unrelated posts, we loose the seriousness and focus we would like to address.
Maybe core team can evaluate and see if they want to create a special section for general discussion that does not show on the front page. Just a suggestion.

Kudos for voicing your opinion !, its upto every individual to choice his/her path, currently their is sheep herding mentality going on (you know what i mean ;)
I have been in this country since 2000, no GC yet, as a matter of fact if my company does not apply for labour in a couple of months , i am sure to go home, my company has said it would apply, but is taking forever. In hindsight, i feel i should have never left India, i have lost on my career development, lost some of my dignity, and feel that i am treated as a 2nd class citizen.
I have decided the GC is for a chosen few ;), not for everybody, I guess i am a coward (whatever that means ?), I prefer to exhuast my H1 and go back Home with some dignity and self respect. It's like this, US is like a mansion (or rather appears to be) , i asked the owner if i could get in, he said OK, i asked the owner if i can stay longer and be here (GC), the owner said he would think about it, now the owner 'OWN's' me, since i have stayed in the mansion for quite long, I am used to the comforts, and not sure if i want to leave or fight the slave trader. I for one, refuse to be labelled, bonded, and treated as 2nd class citizen. I am off to my birth country, and for me its the greatest country, ever on the face of the earth, and i really feel sorry for abandoning it.

Pros of using H1B:
1. If I-485 denied or having issues in getting approved, then you can still continue with your H1B and have peace of mind.
2. You can bring your spouse / dependents using H4
3. Getting Driving License renewal up to the duration of H1 is not a problem.
4. Can renew in 3 years time period after I-140 approval and can avoid frequent renewal of EAD hassle.
5. EAD renewal every year is expensive and can save money!
Pros of using EAD:
1. Can get a job where the company is not willing to sponsor.
2. Can save H1B time and can be used in future, if needed. [I read about this some time back and users need to check regarding it's validity]
3. Can change companies without any documentation using AC21. [USCIS don�t ask don�t tell policy?]

I read on some lawyers site from someone that posted it here in this forum if you move to EAD and surrender your H1 status you can no longer tap in to the unused time frame if you do get in to a situation at a later time. just my 2 cents.

Was this the first time you are coming to USA?

I am going for chennai H1B visa on Feb 6....F1 to OPT to H1B...Scared to helll...
I appeared for an interview on Jan 2nd. It took the consulate officers 16 days to call me and ask for original documents again. Darn PIMS verification! I resubmitted the documents on Jan 22nd through the drop box... and have been calling them daily to track the progress. They say they need 7 working days from the day the documents are received. I have already had to reschedule the flights once..and my employer is getting worried now. If I had known about the delays at Chennai post before, I wont have applied here. Chennai sux!!!

why so? ask yourself. read your own comments. and let us all know how you have helped the process of ending YOUR retrogression.
i have reviewed every post you ever put on iv. i don't see any deleted post.
so you may want to think again. hardly anything is deleted around here. otherwise a lot of intemperate stuff that's posted would disappear.
ultimately it comes to this: if 25,000 members show no interest in contributing in a fund drive (barring the minuscule 500 who did), what's the point in being "friendly". hey- iv is you and me. there is nothing else. no building, assets, stocks. I or aman or pappu or logiclife and every other core member and iv leader are just like you. we have jobs and families to take care of. we are afflicted by immigration retrogression- like you.
we have put in time, money and effort at great cost to our personal lives. i wish i could "like you" to that one too.
if "members" are willing to make this their organization their own- if there is to be this sense of involvement and ownership, then we will succeed. if not, if the attitude for the most is going to be "why should i" and "nope i am not contributing" and "how dare you ask" and "i have free speech" and "why doesn't iv do xyz for me" and "why should logiclife use this and that tenor" and "why did abc say def to me" and "i demand respect" and the best "these are my 2c but don't ask me to lift a finger to do this- iv should do this" then forget it. won't happen. because that IV you are imagining doing wonders and making miracles is YOU.
let me take this opportunity to thank everyone that participated in the fund drive, joined state chapters, met lawmakers, took initiatives to start state groups, ran the funding threads and contributed in any other way.
you are guys are true assets to iv- in fact you are the true iv. kudos to you!

i am with you. we should request that USCIS recapture unused visas!

1) USCIS do not allot immigrant visas, It is alloted by DOS.
2) DOS needs a fix in the current EB laws to capture unused visa.
3) I am not sure if we can push any change in law, given the current Iraq war quagmire.
But I hope they speed up the overall application processing times, with all the increased Fee money they will get from July 30th (by investing money on IT).

The AC21 removed the per-country limit in any calendar quarter in which overall applicant demand for Employment-based visa numbers is less than the total of such numbers available.
Isn't it fair to ask for the reasons why the interpretation of the laws has changed?

I submitted usps money orders for I-485 fees. Filed on july 2nd.
Any way to find out if those money orders are enchashed or no?
I did try google search and so far no answer.
My case is not entirly same. I bought bank money order, and I was told one way to find out is request local branch to call on and find out. I was wonder, may be you could ask usps local office staff about it.

AC21 doesn't contradict any law. AC21 memo is a real memo. It provides guidance for areas that are not clearly defined. So no point in comparing AC21 memo against the latest illegal memo by USCIS.

2. Until the judgment goes against you or you run away, you do not need to worry about freezing bank account
3. In worst case, during the judgment time they will consider your family, two kids. They are not heartless people and it�s just an accident. That guy must be insane to ask 3.25 million. I couldn�t believe the whiplash injury especially when the damage was <$1500. I just assume the impact must be very minimal.
My advice is, don�t lose your hope and sleep. You insurance company is there with you to defend. Keep in touch with them and respond promptly to court notice or any letters. You do not need to withdraw your GC. Worst case if everything goes against you declare bankruptcy and leave the country legally. So if you want to come back in the future, you won�t have much problem.
When you don�t have anything to lose�why do you worry. Keep it cool and every thing will be fine. Seems like those guys wanted to have retirement with your money.
