Theoritcally, these numbers should have been used to reduce backlog in EB2 first, then it should go to EB3. Since no one cared about this, EB3-ROW was free riding in EB2 numbers despite heavy demand in EB2.

Immigration is a privilege when we enter the country. But when we have been here for such a long time, paid our taxes and respected the administration and bureaucracy, it�s our right. As for the job loss, no job is certain for anyone. But at least a GC holder can look for alternate jobs. He is not tied to his labor cert/employer. When employees post for job, they might say �need a citizen or gc holder�. But never say we only need a H1-B holder. So when we have respected and followed the rules of this country immigration becomes a right as logic life suggested.

Don't bet on this too much. Not being pessimistic, but in a democracy it is not just what is done but who does it and how it is done. Why should Republicans in the outgoing Congress vote again on a bill when their majority status is obsolete now? Do you think democrats will allow this outgoing congress to take the credit? they are politicians too, anything crappy in that bill is going to be the new Congress's (read Democrat's) burden. Already, a bombshell is waiting in the form of a hastily passed by the house_hastily signed by teh President bill: there is a fine print that removes oversight of how money is spent in Iraq (at least some of it). So, there may even be review of hastily passed, pre-election bills. anything more like this is going to give this congress very very bad name and the next congress a really bad headache.

Specter did mention that he expects the CIR to be passed in the next few weeks in the lame duck session by the house.. infact he mentioned that the conservative outgoing speaker Hastert in favour of this at this time..so house might pass this now..with the senate already passed this..

I had a quick question to ask. My, current H-1 visa is expiring on July 30, 2008. Also, my current I-94 and I-797 is expirin on the same date. I am eleigible to apply for extension 6 months in advance, starting Jan. 30, 2008. However, my question is if I apply for my H-1 visa extension now (say Feb. 28, 2008) and the extension comes by April 30, 2008; will that invalidate my H-1 visa stamped till July 30, 2008.

There are lot of people from different countries who have exploited asylum system as well.
I actually admire indian graduates of different streams who are able to transfer to computer science so easily.Maybe it is education in basic sciences and Maths earlier.
Sure, there are not Nobel prize winners within our community, but generally, some how, people are able to deliver what is expected of them.If consultants are not of high quality,Hiring companies fire them easily.As it is,there is strong anti H1-B propanganda going on,so if anything we discuss here,can be picked up external groups.

As IV is willing to help those having issues with employers by providing a platform and interfacing with DOS, USCIS, DOL, Media, lawyers and support in any form - nothing stops people from standing up for themselves and report an abusive employer.

HLG will be traveling to Washington DC for a meeting Wednesday with a Senator�s lead staffer on immigration. The Senator is one of the six people who we have regularly mentioned as key on this issue.
The meeting was set-up by one of our best clients. The purpose of the meeting is to impress upon the Senator's staffer the importance of a �bridge� bill to end immediately Schedule retrogression. This is the fifth different HLG staffing company/facility client who has successfully set-up such a meeting in the last six weeks.
We are guardedly optimistic that a bridge bill can be passed in the near term, in spite of Congressional leaders� apprehension. As we have previously mentioned there is an inverse relationship between the likelihood of a bridge bill and CIR. To some degree this is understandable � Congresses overall goal is to pass a major immigration bill that solves many needs, not just healthcare�s desires.
After the Washington DC trip, we head to New York City for our Annual Symposium. We currently have full registration for this event. We look forward to seeing everyone. We�ll try and post over the next few days, although that may be impossible in light of the travel plans. In the meantime, if anyone has any connection with the �Big Six,� please try and set up an appointment. HLG will surely attend and advocate.

I never have and never will like the idea of being asked to pay, I give what I can unasked.
Unfortunately, the statistics paint a different picture of us "members" as a whole... and that's what needs to be addressed asap.
What of the people that by circumstance do currently not have these amounts of money to spare. I should not have to feel excluded nor should I have to explain my very personal reasons why to everyone.Of course! And for those who genuinely cannot pay *the doors are STILL OPEN - prove your commitment by volunteering. Does that work for you? Or (in all seriousness, treat this as a question that needs to be answered) - are you simply looking for a forum/messageboard?
Have you guys looked in the forums lately, people are getting "yelled" at and talked to rudely if they do not disclose how much exactly they have contributed. So we are only allowed to an opinion or help if we have money?Of course not! And I hate that "being yelled at" as much as anybody else on this forum. Which is why the concept of paid membership. Nobody asks you how much you paid/contributed in every second post - isn't that what you really want???
I will contribute when I have money to spare, however it seems I will have to leave this organization based on the comments that have been out there before I get to the point where I can afford to contribute. That goes for both time and money, some of us have responsibilities that we do not want to disclose. So basically all you want is some organization and members to do their work, while you come to the forums, vent your frustrations, pass your time, get some answers and opinions to your problems, and leave to tend to your "responsibilities" - because you have both financial obligations and time commitments that are completely unique, and you are the only person who is saddled with those - whereas everyone else leads a happy, prosperous life, with time and money to spare? Nice!
*sigh* I might have just opened myself up to the ones that like to attack....go ahead...Don't think of this as an attack. That's not the purpose. If this proposal forces you think what's IV really worth to you - regardless of whether you are actually motivated into contributing or volunteering or not - I will consider the time spent on this thread a great investment!
However, if all you think of IV is as a message board and a bunch of idiots trying to fix things that may never get fixed, and if they do - you'll always stand to gain - a membership-based organization would better serve the needs of the rest, imho.

I found this only today.. I do not work for this employer since Jan 2008. On EAD now.. 46 days passed since the date mentioned.. not sure what is this about..
Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.
We reopened this I129 PETITION FOR A NONIMMIGRANT WORKER on January 30, 2008, ...
I found out from prev employer that it was due to the H1 withdrawel petition..

I checked my former approved H1Bs and found:
1) The Sept. 2000 approved H1B with LUD of June 2007
2) The Feb.2003 approved H1B with LUD 0f April 2006
For both cases, it seems the status is the same as when it was approved in Sept. 2000 and Feb. 2003, nothing new. Maybe these are automatic updates by the computer system.

Based on this small number of H-1B immigrants who do not pay Social security, Zazona report generalizes that entire H-1B immigrants do not pay taxes. This is called "Hasty generalization" - a common propaganda weapon employed by unethical writers to confuse their readers.
2. Even the H-1B immigrants who do not pay Social security taxes, however small their number may be, have a right to utilize this feature provided by their home country to safeguard their hard-earned money. They should not be blamed, ridiculed, villified for taking care of themselves in the retirement.
